CFTC Chair Warns Autonomous AI Agents Challenge Financial Rules

Commodity Futures Trading Commission Chair Michael Selig says regulators must adapt as autonomous AI agents begin executing trades and holding assets.

Commodity Futures Trading Commission Chair Michael Selig said autonomous artificial intelligence agents could challenge financial rules built around human market participants, raising urgent questions for regulatory oversight.

Speaking at the CFTC's inaugural Frontier Forum in Washington, DC, Selig stated that it is no longer science fiction to imagine everyday appliances autonomously purchasing groceries with funds earned through Ether staking or launching their own memecoins. According to Cointelegraph, Selig emphasized that regulators must adapt to a financial system where AI software can independently hold assets and execute trades.

Regulatory Questions for Autonomous Software

Selig pointed out that existing regulatory frameworks were designed around identifiable human market participants performing specific financial functions. Autonomous software, however, creates new liability and compliance dilemmas.

"Does the developer of that agent become subject to registration? Who is liable if the agent goes rogue? How can regulators know who the agent, or suite of agents, is trading on behalf of? Do we need a new flavor of know-your-customer, maybe KYA or know-your-agent?" Selig asked during his remarks.

Growing Retail Adoption and Market Risks

The regulatory focus arrives as younger investors increasingly embrace automated financial tools. An eToro survey published in September indicated that 79% of US millennial investors and 77% of Gen Z investors either already used or were open to using AI to select or adjust their investments.

While Selig acknowledged that artificial intelligence could democratize trading by granting smaller participants access to advanced risk management, he also warned of new market risks. Autonomous agents could react unexpectedly to market conditions, and concentrated use of similar models could generate correlated trading behavior that complicates market surveillance.

Crypto exchanges are already integrating automated tools, with Coinbase introducing Agentic Wallets in February and Binance launching AI Agent Skills in March.
